A construction firm has been ordered to pay a £50,000 fine following the fatal fall of a worker from scaffolding at a site in southwest London. The incident involved Antonio Rodrigues, aged 55, who tragically fell through an unglazed window opening while working on New Malden High Street on 27 July 2022.
During proceedings at Westminster Magistrates’ Court on 18 June, Lima Construction Limited, located in New Malden, admitted to violating construction safety regulations. Alongside the fine, the company was also required to cover costs totaling £11,347.
Andrew Verrall-Withers, an inspector with the Health and Safety Executive (HSE), commented on the case, stating, “This is a case where a company which generally tried to maintain good standards of health and safety failed to respond effectively to an unusual situation, with tragic consequences.”
Rodrigues had been employed by Lima Construction as the principal contractor on a redevelopment project involving the transformation of a former department store into a combination of commercial and residential spaces. He fell from scaffolding on the exterior of the building, dropping through a window gap and landing over three metres below on a concrete surface.
