Lady Eleanor Donaldson, spouse of former Democratic Unionist Party (DUP) leader Sir Jeffrey Donaldson, has been found unfit to stand trial due to mental health concerns. As a result, she will undergo what is termed a “trial of facts,” a legal process used when a defendant’s health prevents them from participating in a conventional trial.
This determination was made by Judge Paul Ramsey at Newry Crown Court on Wednesday, following the presentation of medical evidence. Unlike a typical trial, a trial of facts does not allow a jury to issue a guilty verdict; instead, it focuses on whether the defendant committed the acts in question. While a conviction is not possible under this procedure, the defendant may still be acquitted. The process is governed by Article 49A of the Mental Health (Northern Ireland) Order 1986. Although Lady Donaldson will have legal representation, she will not actively participate in the proceedings due to her condition.
Lady Donaldson, aged 60, faces five charges linked to aiding and abetting alleged offenses, all of which she denies. Meanwhile, her husband, Sir Jeffrey Donaldson, 63, has pleaded not guilty to 18 charges concerning sexual abuse. These allegations include one count of rape and additional accusations of indecent assault and gross indecency, spanning the years 1985 to 2008 and involving two alleged victims.
During the hearing, evidence was provided remotely by Dr. Christine Kennedy, a consultant psychiatrist who has examined Lady Donaldson and prepared two reports, the latest being quite recent. Dr. Kennedy attested that Lady Donaldson is currently incapable of instructing lawyers, understanding the court proceedings, or giving evidence. Prosecutors have suggested holding Sir Jeffrey Donaldson’s standard trial, scheduled to start next Tuesday, concurrently with Lady Donaldson’s trial of facts. The judge is expected to decide on Thursday whether both trials should run simultaneously or be held separately
