A nurse based in south London has reached a settlement with the NHS trust following her suspension linked to an alleged breach of a transgender patient’s confidentiality. Jennifer Melle, who works at Epsom and St Helier Hospitals NHS Trust and has been with the hospital for 12 years, was removed from her duties after publicly discussing receiving a warning for using incorrect pronouns in relation to a transgender patient.

In May 2024, Melle was subjected to racial abuse by a transgender woman, who was born biologically male, after Melle addressed the individual as “Mr.” The hospital issued a written warning to the patient concerning their unacceptable racist and threatening behavior. Despite this incident, Melle remained in her role until March 2025, when she was suspended with pay after media coverage of her experience raised concerns that patient confidentiality might have been compromised.

Following a private disciplinary hearing, Melle was reinstated to clinical duties in January without further action being taken against her. Reflecting on the ordeal, she expressed that the entire situation “should never have come to this,” emphasizing that no medical professional should endure such consequences merely for speaking out about racist abuse and threats faced during their work. However, she described this as “the darkest days of my life” and acknowledged that challenges remain, as investigations by the Nursing and Midwifery Council (NMC) are still ongoing.

The NHS trust issued an apology for Melle’s experience, recognizing that racial abuse towards staff is unacceptable while also underscoring the importance of maintaining patient confidentiality. A spokesperson stated: “Racial abuse of our staff is never acceptable, nor is discussing a patient’s private medical information publicly.” The trust confirmed it had taken disciplinary action against the patient and expressed regret over the circumstances that led to the dispute. The NMC has been contacted for comment but has not yet responded
