Comins, aged 52, was just nine minutes into his cycling time trial on the A40 near Raglan in Monmouthshire when Barbu attempted to pass him. Although Comins stated he saw Barbu, he could not explain why he ended up hitting her, admitting that he would be questioning himself about the incident for the rest of his life.
Following the collision, an inspection of Barbu’s van revealed serious issues. The vehicle was deemed unsafe for road use and was carrying a load that exceeded legal limits. According to a vehicle examiner, this would have negatively impacted the van’s ability to brake quickly and maneuver effectively in an emergency situation.
Barbu had moved to the UK in 2002, initially working as a chef at the Old Pandy pub before eventually becoming its owner. He married Maria, a Romanian woman, in 2004, and together they had twins who are now adults. After the incident, Barbu lodged an appeal to prevent deportation, arguing that relocating permanently to Romania would be excessively harsh for both him and his family, especially since he claimed to have no home or income there.
He expressed a strong identification with British culture and considered the UK to be his permanent home. Maria supported this view, stating she would not move to Romania and would struggle to cope without her husband. However, on 7 September, the decision-maker Boyes pointed out that since Barbu’s children are adults and independent, deporting him would not be unreasonably harsh.
