The wife of a firefighter who tragically lost his life while responding to a fire at the former Jenners building in Edinburgh has announced her intention to appeal directly to the Lord Advocate due to significant delays in the investigation of his death. Shelley Martin, aged 39, expressed her deep frustration over the prolonged wait for a decision from the Crown Office and Procurator Fiscal regarding the possibility of prosecuting those responsible.
Barry Martin, her husband, was a recently qualified firefighter aged 38 when he suffered fatal injuries at the scene of the fire on 23 January 2023. According to their lawyer, Aamer Anwar, Barry was the least experienced member of the team present and fell down a flight of stairs within six minutes of entering the building. His breathing apparatus was damaged, leading to a catastrophic lack of oxygen. Although an emergency was declared shortly after, Martin did not exit with his colleagues and was discovered at the bottom of the stairs, being removed from the site 33 minutes after arrival.
In December 2025, a civil case was filed against the Scottish Fire and Rescue Service and Chamic Industrial Services, the contractor responsible for work at the building during the fire. The Crown is reportedly still considering criminal charges, which may include breaches of health and safety regulations or corporate homicide. Shelley Martin insists that Barry was sent into the building “unprepared and underequipped” and argues that his deployment was unjustified as there was no immediate threat to life. She has been seeking answers for over three years, describing the ongoing delays as deeply painful and detrimental to their pursuit of justice.
The Scottish Fire and Rescue Service, represented by deputy chief officer Andrew Watt, emphasized that they are cooperating fully with Police Scotland and the Crown Office, which are leading the ongoing investigation. A spokesman from the Crown Office noted they had received the usual prosecution reports from the Health and Safety Executive but stated the inquiry is still active, promising to keep the family informed of any major developments.
