West Wickham KFC franchisee to pay £70k fine over 'slave' comment

A franchisee operating a KFC in south-east London has been ordered to pay close to £70,000 following a tribunal ruling involving racial discrimination and wrongful dismissal. The case centered around Madhesh Ravichandran, an employee originally from Tamil Nadu, India, who started working at the West Wickham branch of KFC in January 2023.

According to the tribunal, just two months into his employment, Mr. Ravichandran was denied annual leave. During this period, the branch manager, Kajan Theiventhiram, was overheard telling a colleague that he would give priority to staff of Sri Lankan Tamil background and disparagingly referred to Mr. Ravichandran as “this slave.” The tribunal found these acts constituted direct race discrimination, harassment on racial grounds, and victimisation against Mr. Ravichandran.

Following these incidents, Mr. Ravichandran chose to resign several months later. However, the tribunal noted that the employer failed to conduct a meaningful investigation into his serious allegations. The judge emphasized that the refusal to grant leave was heavily influenced by racial discrimination and acknowledged that Mr. Ravichandran was subjected to unfairly long working hours due to Mr. Theiventhiram’s racial prejudice.

Ultimately, the tribunal awarded Mr. Ravichandran £66,800 in compensation. It also recommended that Nexus Foods Limited, the company managing the West Wickham KFC franchise, introduce a comprehensive training program to educate all staff about workplace discrimination, aiming to prevent similar incidents in the future
