Windrush man from Chelmsford to receive £25,000 from Home Office

Thomas Tobierre, a 71-year-old resident of Chelmsford, Essex, who arrived in the UK in 1960, has been offered £25,000 in compensation due to the mishandling of his case under the Windrush Compensation Scheme by the government. He was forced to use his pension savings of £14,000 after being unable to work because of insufficient documentation, which led to financial struggles. Despite appealing to the scheme for reimbursement, he was initially denied.

After being made redundant in 2017 following over 40 years of work, Tobierre found himself unable to secure another job due to his inability to prove his right to live and work in the UK. This forced him to rely on his savings and access his private pension, resulting in financial strain. Despite being granted his UK employment rights in 2018 following the Windrush scandal, he was underpaid by the compensation scheme due to the oversight of not accounting for his pension withdrawal.

Following an investigation by the Parliamentary Ombudsman, the Home Office was criticized for its confusing and inconsistent approach to handling pension-related claims under the Windrush Compensation Scheme. As a result, Tobierre was eventually offered the compensation he deserved, including funds for his daughter, Charlotte. Unfortunately, Mrs. Tobierre’s claim for compensation to cover her funeral costs was handled insensitively, leading to additional distress for the family.

Charlotte Tobierre expressed the exhaustion and emotional toll the prolonged process took on her family, which overshadowed her mother’s battle with cancer. The ombudsman recommended that the Home Office issue an apology to the Tobierre family, as well as review their complaint handling procedures and reconsider the exclusion of pension losses from compensation claims. Despite the challenges faced, the family’s perseverance ultimately led to the acknowledgement of their suffering and receipt of the compensation owed to them
