Miss Robinson’s legal battle stemmed from her parking at the Feethams Leisure car park in Darlington starting in June 2021. She diligently paid for parking each time but occasionally faced challenges with poor phone signal and payment app issues. Despite initially paying the fines, she later decided to appeal against the parking charge notices (PCNs) after Excel Parking insisted she pay £11,390 for a total of 67 unpaid charges.
In a courtroom showdown at Middlesbrough County Court, barrister Seth Kitson defended Miss Robinson and successfully argued that Excel Parking’s penalties were unenforceable. District judge Janine Richards ruled in favor of Miss Robinson, dismissing Excel Parking’s claims and ordering the firm to pay legal costs amounting to £10,240.10. The judgment highlighted Excel Parking’s unreasonable behavior throughout the litigation and ultimately held them accountable for their actions. Excel Parking’s attempts to contest the ruling were denied, leading to the firm having to pay the fees to a charity called the Access to Justice Foundation
