Cliff Donaldson, who suffered from two strokes in January 2023, settled a disability and age discrimination lawsuit against his former employer for £100,000 after losing his job. Donaldson’s speech and movement were affected by the strokes, leading to reduced working hours and salary. The case was brought against Fraser Partners Ltd after a younger site manager was hired, and Donaldson was informed his employment would end.
Fraser Partners settled the case without admitting liability, stating that they maintain a commitment to workplace equality and inclusion. Donaldson expressed shock at being let go after 40 years with the company, mentioning his mental health suffered tremendously. He reflected on the uncertainty he faced without a job or income following the strokes.
Having joined Fraser Partners in 1986, Donaldson took eight weeks off work after the strokes before returning gradually. The Equality Commission for Northern Ireland supported his case, highlighting the importance of employers fulfilling obligations under the Disability Discrimination Act. Geraldine McGahey of the commission emphasized the need for employers to communicate with employees about their rights and make necessary adjustments to support them.
McGahey mentioned that the resolution resulted in a significant settlement and urged companies to review their policies and ensure proper implementation. She emphasized the impact of employer behavior on employee loyalty and reputation.
