Jodi Law, a salon owner from East Midlands, is gearing up for a crucial hearing in her ongoing trademark dispute with global cosmetics giant L’Oréal. Rebecca Dowdeswell attempted to renew the trademark for her Leicester-based business, nkd, in 2022, but faced opposition from the French company due to their trademark on beauty products called Naked.
Despite feeling a “much stronger position” with a set Intellectual Property Office (IPO) hearing date, the 49-year-old mother of two from Radcliffe-on-Trent in Nottinghamshire lamented forgetting to renew the nkd trademark, calling it a “big mistake.” L’Oréal objected to her use of the name nkd, citing potential consumer confusion with their Urban Decay makeup brand’s range of eye shadow palettes called Naked.
The delay in the hearings, attributed in part to Brexit-related caseloads, gave Dowdeswell a temporary reprieve from the stress of contesting L’Oréal’s opposition, for which she had spent over £30,000. However, she expressed readiness to resume the fight, asserting that she is not going to give up despite the challenges faced in the three-year legal battle.
In response, a spokesperson for L’Oréal emphasized their commitment to resolving the matter with Dowdeswell and expressed optimism in finding a mutually agreeable solution. The IPO confirmed a hearing date had been set for November 5, with an expected decision about nine months later.
