A transgender doctor at NHS Fife was confronted by a nurse in a changing room, sparking controversy at the hospital. Head of nursing Gillian Malone described the nurse, Sandie Peggie’s behavior as “unacceptable” and suggested that there were better ways for her to express concerns about sharing facilities with Dr. Beth Upton, a trans woman.

The incident between Ms. Peggie and Dr. Upton occurred on Christmas Eve in 2023 at Victoria Hospital in Kirkcaldy, leading to Dr. Upton filing a complaint against Ms. Peggie with NHS Fife. Subsequently, Ms. Peggie was suspended on January 3, 2024, prompting her to claim that her treatment violated the 2010 Equality Act and take legal action against NHS Fife, with proceedings resuming on Wednesday after a five-month break.

During the tribunal, Ms. Malone emphasized the inappropriateness of confronting a colleague in such a manner, advising that concerns should have been raised in a more constructive way. She suggested that Ms. Peggie should have first discussed the issue with her line manager before escalating it further. The incident in the changing room allegedly involved Ms. Peggie questioning Dr. Upton about her chromosomes and mentioning a transgender rapist, Isla Bryson.

Ms. Cunningham, representing Ms. Peggie, questioned whether it was possible to raise concerns directly with Dr. Upton without facing suspension. Ms. Malone defended the decision, stating that there was no other way to resolve the matter during that particular conversation. The core issue seemed to be Ms. Peggie feeling intimidated by Dr. Upton’s presence in the changing room. Despite the suspension and subsequent disciplinary proceedings, Ms. Peggie was ultimately cleared of gross misconduct by NHS Fife due to insufficient evidence to support the allegations against her
