Following a recent legal ruling, several schools in Scotland are making changes to their bathroom facilities. Previously, these schools only had gender-neutral toilets, but now they are creating separate single-sex bathrooms for boys and girls. This decision comes after a judge ordered Scottish schools to provide single-sex toilets for students.
The responsibility for the school estate, including toilet provision, falls on local authorities in Scotland. While most schools in the country already offer some form of gender-neutral bathrooms, they also have single-sex facilities. The regulations around gender provision in school toilets have not been updated in nearly 60 years, since the School Premises (General Requirements and Standards) (Scotland) Regulations 1967 were implemented.
In response to the court ruling, different councils in Scotland are considering their next steps. Dumfries and Galloway Council is assessing its position before making any changes, while City of Edinburgh Council is determining what adjustments may be necessary. Several other councils have confirmed that they have at least one school without single-sex facilities, but they have not provided updates on any potential changes. Additionally, some councils stated that none of their schools offer gender-neutral provision for students.
