An investigation into corporate manslaughter has been initiated due to failures that resulted in the deaths or injuries of numerous babies at maternity units in Nottingham. Nottinghamshire Police is currently looking into whether the maternity care provided by the Nottingham University Hospitals (NUH) NHS trust was grossly negligent. This trust is under scrutiny for being involved in the largest maternity inquiry in NHS history, with around 2,500 cases of neonatal deaths, stillbirths, and harm to mothers and babies being examined by independent midwife Donna Ockenden.
The focus of the police investigation will be on two maternity units overseen by the Nottingham University Hospitals NHS Trust, which are responsible for running the Queen’s Medical Centre and Nottingham City Hospital. NUH expressed deep regret for the pain and suffering caused, acknowledging the need for accountability. In a statement posted on the police force’s website, Det Supt Matthew Croome from the investigation team emphasized that corporate manslaughter is a serious criminal offense. The investigation aims to determine if the organization as a whole, rather than specific individuals, is responsible for the gross negligence leading to a person’s death.
Nottinghamshire Police’s investigation, known as Operation Perth, has already received over 200 family cases related to deaths and serious injuries connected to NUH’s maternity care. This development comes after the trust was fined £1.6 million for “avoidable failings” linked to the deaths of three babies in 2021. Dr. Jack and Sarah Hawkins, parents of Harriet, who was stillborn in 2016, expressed that this is a step towards accountability. They believe that a prosecution for corporate manslaughter would only penalize the trust itself, rather than holding individuals responsible for the harm caused.
