A man who got into a deadly altercation with a friend while under the influence of alcohol has been sentenced to over five years in prison. Dawid Majewicz, aged 43, used a kitchen knife to fatally wound Jacek Dembinski, 44, at the Rosehill Court tower block in Aberdeen in August of last year. Despite undergoing emergency surgery at Aberdeen Royal Infirmary, Mr. Dembinski succumbed to complications from his injuries.
Initially facing a murder charge, Majewicz confessed to the lesser offense of culpable homicide. Subsequently, he received a prison term of five years and four months at the High Court in Edinburgh. The court heard that Majewicz, a car valet, admitted to assaulting and causing the death of Mr. Dembinski on August 27th. His criminal record also revealed three prior convictions for violent attacks.
According to Advocate depute Louise Beattie, Majewicz and Dembinski were spotted together in an elevator at Rosehill Court before entering Majewicz’s flat within the building. A neighbor overheard intermittent noises indicating a dispute. Majewicz claimed that they had been drinking at his residence when an argument ensued and Dembinski reportedly picked up a bottle in a threatening manner. The situation escalated further when Majewicz grabbed a knife and used it after being struck with the bottle.
Following the violent episode, witnesses saw Mr. Dembinski bleeding heavily from his arm in the elevator. Local residents who spotted him outside promptly contacted emergency services. Despite the medical attention he received, Mr. Dembinski passed away due to complications from his arm injury. During the court proceedings, Defense counsel David Moggach stated that Majewicz deeply regretted his action and did not intend for the incident to turn fatal. Lord Scott, in delivering the sentence, emphasized that imprisonment was the suitable punishment to not only penalize Majewicz but also deter others from similar acts of violence.
