A nurse involved in an employment tribunal against NHS Fife is now facing a separate disciplinary hearing by the health board. Sandie Peggie claims she was subjected to unlawful harassment by being required to share a changing room with Dr. Beth Upton, a transgender woman, at Victoria Hospital in Kirkcaldy. The case has been adjourned until July, as the health board disputes Peggie’s claims.
NHS Fife has scheduled a conduct hearing to investigate allegations against Peggie of misconduct, failures of patient care, and misgendering Dr. Upton. Possible outcomes range from no case to dismissal. Peggie’s legal team plans to take further action with another tribunal claim in response to the disciplinary hearing, while NHS Fife has yet to provide a comment on the situation.
During the employment tribunal proceedings, it was revealed that Peggie had encountered Dr. Upton in the women’s changing room on multiple occasions. Peggie, who has been a nurse at NHS Fife for over 30 years, expressed discomfort and asserted that Upton should not use the women’s changing area. The interactions between the two parties have been disputed by both sides.
Dr. Upton made a complaint of bullying and harassment against Peggie, resulting in the nurse being placed on leave and then suspended for eight weeks pending an investigation. Peggie defended her actions, stating that it was discriminatory for a transgender individual not registered female at birth to use the women’s changing room.
