Newport council has accused James Howells of attempting to bribe them while trying to recover a hard drive containing Bitcoin worth about £600m that he believes is in a landfill. Howells said he is within his rights to sue the council to gain access to the site or seek £495m in compensation. He also offered to donate 10% of the Bitcoin to the local community. Council barrister James Goudie KC claimed that Howells’ offer was encouraging the council to “play fast and loose” by “signing up for a share of the action”.
The council stated that there is “no duty” on the council to excavate its landfill site at Howells’ request, and that the law means that property deposited at landfill sites belongs to the local authority. The council argued that its environmental permits prohibited it from disrupting the area in pursuit of the hard drive. They also claimed that the time that had elapsed since the hard drive was dumped in the landfill made any claims over it invalid.
Howells’ barrister, Dean Armstrong KC, said the case should proceed to trial and judgement to deny this would result in a “grave injustice” to Howells. “We seek, plainly and candidly, a declaration of rights over the ownership of the Bitcoin,” Mr Armstrong added.
High Court Judge Keyser KC has reserved his decision until a later date
