A 62-year-old man from Birmingham has escaped jail time after admitting to owning a dog that injured an 11-year-old girl. Farhat Ajaz was given a two-year suspended sentence after pleading guilty to three counts of owning a dangerous dog which caused harm while out of control. The girl was injured in September 2023, when the dog attacked her. Two other men were also harmed while attempting to stop the attack. The court heard that Tyson, the dog in question, was “likely to be an XL Bully”.
The dog’s attack was one of many around the country that prompted the UK government to consider a ban on the breed. During the hearing at Birmingham Crown Court, the judge heard how Ajaz had threatened to kill a former partner during a campaign of harassment. He had been subject to a lifelong licence at the time of the offences, having served 25 years of imprisonment before his release in 2004.
Judge Heidi Kubik KC called the incident a “horrific attack” and the “vile, threatening and abusive” harassment of a former partner in 2022, which in itself merited a custodial sentence. Despite Ajaz having lung disease, cardiac problems, and an array of health issues, losing the use of an arm and walking with crutches, Kubik said the attack had been “horrific”.
Ekwal Tiwana, representing Ajaz, did his best to alleviate the damage. He argued that the situation was “a sheer act of stupidity” and that his client “got the dog for his son”. Proving Ajaz’s remorse, Tiwana pointed out his client’s guilty plea and his attempts to stop the dog. Yet Kubik gave Ajaz a restraining order and a lifetime ban on owning a dog. The victim was out shopping with her elder sister when she was attacked, being left with scarring to her arm and shoulder.
