Kadi Bayoh, sister of Sheku Bayoh, has called for the scope of the ongoing public inquiry into her brother’s 2015 death to be expanded. Mr Bayoh died after being restrained by police in Kirkcaldy, Fife. The inquiry has been examining the case, focusing on the circumstances of Mr Bayoh’s death and whether race played a part. The Bayoh family has now claimed that unless the inquiry’s remit is broadened to include the Crown Office’s failure to bring prosecutions, they will feel cheated of closure.
The issue is now being considered by the Scottish government, with the inquiry’s chair, Lord Bracadale, calling for a decision to be made on the family’s request “as soon as possible.” The first phase of oral submissions is due to begin in December. The family lawyers are also calling for an investigation into why neither the police nor the force itself was held accountable.
The inquiry has been ongoing since November 2022 and has cost over £20m thus far. Speaking following the conclusion of the first stage of hearings, Kadi Johnson expressed her disappointment. “We have come this far because we want to know why Sheku died and how he died,” she said. “But if we don’t get there, then we have no closure.”
The inquiry has attracted controversy, with family lawyers claiming that the Scottish criminal justice system is “institutionally racist.” Barrister Aamer Anwar, who represents the Bayoh family, accused the government of “stonewalling” over the request to expand the inquiry. He also noted that unless the remit is widened, other families will be denied justice, as the Crown Office will be able to “cover up” its failures
