The recent malfunction in the UK’s air traffic control system, which resulted in widespread flight disruptions, has been described as preventable by the Transport Secretary. Speaking in the House of Commons, Heidi Alexander announced that she has commissioned an independent inquiry led by the aviation regulator into the system managed by Nats. This system experienced a four-hour outage on Tuesday, causing significant delays and cancellations affecting over 2,000 flights, with passengers facing major difficulties traveling to and from the UK.

Following discussions with Martin Rolfe, the chief executive of Nats, Alexander confirmed that a cyberattack was not to blame for the failure. However, she emphasized her belief that the incident could have been avoided. Nats has formally apologized for what marks its third major technical disruption within three years. Given that the government holds a 49% stake in Nats, Alexander reviewed with Rolfe the company’s response efforts aimed at minimizing disruption as quickly as possible. She highlighted the necessity of scrutinizing the resilience of Nats’ systems and raised concerns about potential consumer compensation.

Despite calls from airlines such as Wizz Air and Ryanair for Rolfe to resign, the government stated its confidence in his leadership, noting that he has headed Nats for eleven years. Nats has been tasked with investigating the root cause of the outage and is expected to provide a report within one week. The Civil Aviation Authority (CAA) has also been requested to conduct an independent review and deliver findings within six months. Airlines UK, representing the country’s carriers, expressed serious concerns about the recurring failures. Tim Alderslade, Airlines UK’s chief executive, criticized the current system for placing financial burdens on airlines due to errors made by others and stressed the importance of aligning accountability with responsibility, referencing the Civil Aviation Bill as a potential avenue for reform.

When it comes to passenger rights, the UK Civil Aviation Authority indicated that compensation claims are unlikely to be successful in this case. The CAA reminded airlines of their obligations to care for passengers affected by delays or cancellations but stated that the disruption caused by this technical fault would probably be classified as “extraordinary circumstances,” exempting airlines from liability for compensation resulting directly from the incident.

Nats initially announced it was investigating a “technical issue” at 13:46 BST on Tuesday, which was impacting flight departures. The problem originated at their Swanwick Centre in Hampshire, one of two air traffic control facilities managed by Nats, with the other located in Prestwick, Ayrshire. Approximately 90 minutes later, Nats identified the fault as being related to its flight processing system. This system is responsible for managing flight plans and operational data that air traffic controllers rely on to ensure a safe and efficient flow of air traffic through UK airspace.

By 19:30 BST, Nats declared that the system problem had been resolved and that efforts were underway to handle the backlog of delayed flights. However, the fallout from the technical failure persisted, with flight analytics company Cirium reporting that over 2,000 flights had been cancelled or failed to depart by Wednesday evening. Airports most severely affected included Heathrow, Gatwick, Manchester, and Birmingham.

A spokesman for Heathrow noted on Wednesday that its operations were “recovering” with flights continuing to operate, although delays were expected as crews and aircraft repositioned. Gatwick reported a resumption of flights but warned that it would take additional time to fully restore normal operations. Other airports including Manchester, Luton, Stansted, Bristol, and Belfast City had resumed flights by Wednesday, though some, such as Bristol, Belfast, and Luton, were still experiencing ongoing knock-on disruptions
