Scotland’s prisons are preparing to release nearly 1,000 inmates early in the coming months, with the process set to commence on Tuesday. This emergency measure was approved by the Scottish Parliament, following a vote of 66 to 51 in favor. The decision comes in response to the record-high prison population of 8,431, which was reached last week.
The early release initiative will focus on prisoners serving sentences of less than four years, with exclusions for those convicted of sex offences and domestic abuse. The Scottish government has emphasized that this action is necessary to safeguard the well-being of both staff and inmates. However, opposition parties have criticized the move, attributing it to alleged mismanagement within the criminal justice system by SNP ministers.
Despite previous efforts to alleviate prison overcrowding through early releases, the Scottish Prison Service has struggled to keep up with rising numbers. Even after freeing over 300 individuals, including many convicted of violent crimes, in February and March, the prisons remain packed beyond their intended capacity of 7,805. Additionally, more than 120 individuals on custodial sentences have been transitioned to home detention curfews in recent times, further highlighting the strain on the system.
The Prisoners (Early Release) Scotland Act 2025 was enacted earlier this year in response to mounting prison populations. This legislation reduced the point of release for eligible short-term prisoners from 50% to 40% of their sentence, offering some relief for overcrowded facilities.
