Sandie Peggie, a nurse who was suspended following an altercation with a trans doctor in a women’s changing room, has initiated a new legal claim against NHS Fife. This legal action is separate from her previous case with the health board and Dr. Beth Upton, whom she took to an employment tribunal. Peggie alleges harassment and victimization under the Equality Act 2010, citing her gender critical beliefs as the basis for her claims.
The new claim by Peggie stems from three senior staff members who opposed a decision by another manager to lift her suspension in March of last year. This information only came to light during evidence presented as part of the tribunal proceedings. Peggie’s legal team has announced their intention to file further claims of harassment and victimization against both the health board and specific employees in the coming months, with NHS Fife denying any wrongdoing in their treatment of the nurse.
The dispute between Peggie and Dr. Upton, which occurred on Christmas Eve of 2023 regarding the use of female changing facilities at the Victoria Hospital in Kirkcaldy, led to Peggie’s suspension and subsequent legal action against NHS Fife. The tribunal, which began in February and included testimony from over 15 witnesses, highlighted the involvement of three senior managers – Dr. Kate Searle, Dr. Maggie Currer, and Esther Davidson – against whom Peggie is now pursuing legal proceedings.
Margaret Gribbon, solicitor for Peggie, revealed that the latest legal action against NHS Fife and the three managers was initiated on August 6. The claim, alleging harassment and victimization under the Equality Act 2010, was prompted by the senior managers’ objection to lifting Peggie’s suspension in March 2024. Further claims related to Peggie’s disciplinary hearing and a contentious media statement released by NHS Fife are anticipated to follow, with Peggie considering legal action against those responsible for approving the statement
