Tata Steel has been fined £1.5m following an incident where a contractor lost his life while working at the company’s Port Talbot plant. Justin Day, a 44-year-old employee of Mii Engineering, was tragically found crushed by a steel beam in a “hot rolling channel” on 25 September 2019. His family, residing in Llansamlet, Swansea, expressed their devastation at his untimely death and criticized the lack of support provided by Tata Steel during the aftermath.
The Health And Safety Executive (HSE) conducted a thorough investigation into the incident, which was described as “long and complex,” leading to the conclusion that actions needed to be taken. During the court proceedings, it was revealed that Mr. Day had finished his work in an isolated area that was supposed to be safe for movement. However, upon returning to the site after an oil leak was reported, he unwittingly triggered the machinery to move, resulting in the fatal accident.
While passing the sentence at Swansea Crown Court, Judge Geraint Walters acknowledged Mr. Day’s experience in such work and the risk assessment that had been conducted. Nevertheless, he pointed out discrepancies in communication protocols that could have prevented the tragedy. Despite Tata Steel’s prior history of health and safety offenses, the judge emphasized that no amount of fine could undo the loss suffered by Mr. Day’s family, friends, and colleagues.
Following the hearing, Mr. Day’s wife, Zoe Day, spoke about the profound impact her husband’s death had on their family. She described him as a beloved man who was cherished by everyone around him, leaving behind a devastated community. Mrs. Day criticized Tata Steel for the lack of emotional support or outreach following the incident, highlighting the ongoing pain and struggle for closure that their family endures. In response, Tata Steel reiterated their condolences to the bereaved family and emphasized the importance of prioritizing safety in the workplace to prevent such tragedies from reoccurring
