Taking legal action against the Royal College of Nursing over a lack of support in her dispute with NHS Fife, nurse Sandy Peggie is making headlines. Peggie claimed that the RCN did not offer the necessary assistance after she was suspended by NHS Fife in 2024 for allegedly bullying and harassing Dr. Beth Upton at Victoria Hospital in Kirkcaldy, Scotland. Despite these allegations, Peggie was ultimately cleared of any wrongdoing by the health board.
In response to her suspension, Peggie filed a complaint of sexual or harassment related to a protected belief against the health board and Dr. Upton under the 2010 Equality Act. Placed on leave on December 30, 2023, and formally suspended on January 4, 2024, Peggie underwent a lengthy disciplinary investigation into claims of gross misconduct. She reported seeking advice from the union but found their response lacking in advocacy, contributing to her alleged mistreatment.
According to Peggie’s lawyer, Margaret Gribbon, the RCN failed to fulfill its role as a trade union by not advocating for female members deprived of single-sex spaces at work. Gribbon emphasized that had the RCN acted as expected, Peggie may have been spared the 18-month disciplinary process and subsequent legal action against Fife Health Board. Despite these claims, the RCN denied all allegations made by Peggie.
Detailing their guidelines from 2021, the RCN stated that members have the right to receive support regardless of various factors. The union maintains the right to decide the nature and extent of advice and guidance provided to members. Despite these guidelines, the RCN refuted Peggie’s claims and stated they have responded to the legal action taken against them. The dispute began when Peggie expressed discomfort around Dr. Upton in a changing room on multiple occasions, leading to a confrontation on Christmas Eve that ultimately resulted in Peggie’s suspension
