Survivors of strangulation and their advocates have hailed new guidance issued by the Sentencing Council on the sentencing of offenders. The guidelines are the first for judges in England and Wales on the types of sentences that should be imposed for those found guilty of strangulation or suffocation. The new recommendations include legal advice on the culpability of the offender and the length of sentences. There are also details of the aggravating factors that increase the severity of sentences, including whether children were present during the offence or if the victim was pregnant at the time, whilst maintaining a focus on reducing the seriousness of charges if the offender shows remorse, has an established mental disorder or learning disability.
